Spota Terms of Service

By creating an account or using Spota, you agree to be bound by these Terms of Service, our Privacy Policy, and any community guidelines referenced herein.

👤 2. User Eligibility

Must be at least 13 years old (or 16+ in some jurisdictions)
Users under 18 must have parental consent
Spota may suspend access if age, identity, or account behavior violates our policies

🔧 3. Use of the Platform

You may use Spota to:

Create a digital garage and showcase your car(s)
Go live and share your real-time location to nearby users voluntarily
Submit and receive spot media
Engage with car-related content
Participate in XP, badges, and leaderboards

You may not use the platform to:

Harass, stalk, or track others without consent
Post hate speech, explicit content, or violent material
Upload misleading vehicle data or impersonate other users
Engage in unauthorized promotions or scams
Reverse engineer or exploit the app technically

🔐 4. Account Security

You're responsible for keeping your credentials confidential
You must notify Spota immediately of unauthorized activity
We reserve the right to suspend or delete accounts due to policy violations

🎥 5. User-Generated Content (UGC)

You retain ownership of any photos, videos, or media you upload
By uploading content, you grant Spota a non-exclusive, royalty-free, global license to display, promote, or distribute it across the app and marketing channels
You may not upload content you don't have the rights to (e.g. stolen photos, copyrighted music)

🚗 6. Car Spotting & Live Features

Spotting Guidelines:

Only spot cars in public spaces where photography is permitted.
Respect private property and do not trespass to take photos.
Do not interfere with or approach vehicle owners without permission.

Live Session Rules:

Live sessions must comply with all local traffic and safety laws.
Do not engage in dangerous driving behavior while broadcasting.
Respect other road users and maintain safe driving practices.

⛔ 7. Misuse Policy

Prohibited Activities:

Attempting to spoof GPS or falsify spot data.
Creating fake garages or impersonating vehicle owners.
Abusing the "Go Live" feature to intentionally spam users.
Reuploading spotted media rejected by the original car owner.
Using bots, scrapers, or unauthorized third-party apps.

Prohibited Content:

Content that promotes illegal activities or dangerous driving.
Harassment, bullying, or discriminatory content.
Copyrighted material without proper authorization.
Personal information of others without consent.

📊 8. Subscription & Billing

Subscriptions are monthly or yearly and renew automatically unless cancelled.
All payments are processed securely via a third-party (e.g. Google Play, Apple App Store, Stripe).
No refunds are issued for unused subscription time unless required by law.

🗺️ 9. Location Usage

Location data is used to provide map features and real-time updates.
Location tracking is optional and activated only when users manually engage "Go Live"
Spota does not track you continuously in the background unless permission is explicitly granted
Location data is encrypted and not publicly visible unless you choose to go live

🚗 11. Garage & Vehicle Information

Vehicle Profiles:

You may only add vehicles that you own or have permission to represent.
Provide accurate vehicle information and modification details.
Keep vehicle information updated and current.

👥 12. Community Guidelines

Respectful Behavior:

Treat all community members with respect and courtesy.
Engage in constructive discussions about cars and modifications.
Report inappropriate behavior or content to help maintain community standards.

🔒 13. Intellectual Property

Spota and its original content, features, and functionality are owned by Spota Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

🔒 14. Limitation of Liability

Spota is not liable for any damages arising from the use of our services, including but not limited to personal injury, property damage, or data loss. Users are responsible for their own safety and compliance with local laws.

Spota may suspend or terminate your account at any time for violations of these terms, or for any activity deemed harmful to the community or platform.
